PURCHASE AGREEMENT CONTRACT

Every puppy born at WeeChis is very important to us. Our babies are raised under foot with love and treated as members of our family before they are born. We do everything we can to ensure proper growth both physically and mentally and we care what happens to every one of our babies. As breeders, we create life and it is our duty to make sure every baby we create receives the best care from the best owners. Some of our restrictions may seem extreme, but the restrictions are made to protect each and every puppy.

This agreement governs the sale of the following puppy:

Buyer accepts responsibility of caring for this puppy, and will provide properly for its welfare.

Buyer agrees to keep this puppy in a clean and pleasant environment, uncaged (with the exception of crate training) and with proper nutrition, health care, toys and companionship.  

Buyer agrees that if this puppy is found to be neglected or mistreated, Seller shall have the unconditional right to reclaim this puppy WITHOUT refund of the purchase price. Neglect shall include, but is not limited to: being left alone without human companionship for more than 8-10 hours per day, lack of proper sanitary facilities, being caged, poor diet, poor health, lack of regular veterinary exams (standard puppy visits and yearly exams after 1 year of age), improper grooming, and otherwise poor condition. Mistreatment shall include, but not limited to lack of proper food, clean fresh water and physical abuse.  

Buyer agrees if purchasing this puppy as a show prospect, the puppy will not be bred before 18 months of age and will not be allowed to produce puppies in intervals less than 9 months apart. Also, under NO circumstances shall any puppies produced by the above mentioned puppy be sold to pet shops, puppy mills, brokers, flea markets, auctions, research laboratory or similar facility nor will any puppies be sold to anyone without duplicating this purchase agreement and executing it to the fullest extent. Show prospects are not guaranteed to achieve titles. They do possess the qualities needed to be shown in the show circuit and are within the AKC standard for their breed. Achieving titles can be very difficult and strenuous on dogs and it takes a great deal of commitment and dedication on the owner/handlers part to achieve championship! 

Buyer agrees that this puppy will never be allowed to roam freely, without human adult supervision.

Buyer agrees that this puppy will receive prompt, top notch veterinary care and will never be allowed to harbor any internal or external parasites. Should veterinary care become necessary at any time, day, night, weekend or holiday, the buyer will bring the puppy to a reputable licensed, practicing veterinarian immediately.

Buyer agrees that under NO circumstances will this puppy EVER be sold, leased, or given to any pet shop, puppy mill, broker flea market, auction, animal shelter, research laboratory, or similar facility. Furthermore, it is agreed that transfer of ownership of this puppy to another party may only be done with expressed written permission by the seller. If the puppy can no longer be kept, seller has the right of first refusal. With or without refund of the purchased priced, deemed by the seller.

HEALTH GUARANTEE: This puppy is guaranteed of good health upon delivery or arrival, and for a period of 14 days thereafter, provided the puppy is examined by a licensed, practicing veterinarian. Failure to have the puppy examined by a veterinarian will void this health guarantee.  We also recommend that this puppy be quarantined from all other animals during this initial period. If found to be medically unfit with a life threatening illness, it must be reported to the seller immediately. If the buyer wishes to return to the above mentioned puppy it will be at buyers expense. Upon its return to the seller, it will be replaced with another puppy of equal quality and value. If no replacement is available at the time of return, seller has 1 year to furnish a comparable puppy to the buyer. If within the initial period, seller, if buyer wishes, will refund the purchase price. The buyer agrees to provide immediate veterinary care to any puppy showing signs of distress or illness or injury. Failure to do so will render the health guarantee clause null and void. Under no circumstances is this puppy to be destroyed prior to notification by the buyer to the seller. If the puppy dies within the initial guarantee period, despite veterinary treatment, compensation or substitution will be made ONLY if a licensed, practicing veterinarian certifies the cause of death. It is the sellers right to ask for the puppy to be returned for identification at the buyers expense, before providing a replacement or any compensation.

Should this puppy die within the first five years of life due to a congenital defect the puppy will be replaced only if a necropsy is performed by a licensed, practicing veterinarian and a certificate is provided as proof of cause of death from the veterinarian who performed the necropsy. A replacement puppy will be made of equal quality and value within one year after contacting the seller.

Any legal action, which may arise under the terms of this contract, will be brought into the hometown of the seller. Buyer will be liable for all court costs and related charges including but not limited to attorney’s fees associated with seller enforcing the terms of this contract. This agreement is the entire agreement between seller and buyer.

In signing this document, Buyer acknowledges that he/she has read, fully understands, and agrees to all of the terms and conditions of the above sale.
